During his arraignment on Friday, the driver involved in a road-rage incident that resulted in the death of a construction worker on Manhattan’s Upper East Side was ordered to be held on $50,000 bond.

Andre Mosby, 26, allegedly struck and killed Roberto Velez Alvarez, a 54-year-old construction worker from Long Island, after a verbal dispute. The incident occurred around 4PM on Wednesday, causing Alvarez to crash through the glass storefront of a café on East 60th Street.

Prosecutors revealed that Mosby, who is facing a charge of first-degree manslaughter, was driving with a suspended license at the time and had his girlfriend and three children in the car. Assistant District Attorney Shilpa Kalra stated during the hearing at Manhattan Criminal Court that Mosby accelerated his vehicle after Alvarez slashed two of his car tires.

According to Kalra, “The decedent gets in front of the defendant’s car while holding the knife, and the defendant accelerates his vehicle running over the decedent and crashing both into the decedent and the defendant’s own vehicle in a large glass storefront, causing the storefront to completely shatter.”

Disturbing footage shows the moment Mosby drove his 2014 Volkswagen Jetta into Alvarez, propelling him through the front of Cafe Oxford and causing bystanders to scream in horror. Alvarez suffered severe injuries and was pronounced dead less than 30 minutes later.

The altercation began when Mosby lightly tapped the back of Alvarez’s 2020 Chevrolet Silverado pickup truck with his own vehicle, according to police reports.

During the arraignment, Mosby’s attorney, Scott Gallagher, described his client as a “family man” who takes pride in being a stay-at-home dad and caring for his children on a daily basis.

After the incident, Mosby claimed to the police that he had only intended to disarm Alvarez and protect his family, stating that his foot slipped off the brake and onto the gas pedal.
