Could NYC Get Marijuana Smoking Ban In Upcoming Bill?

New Yorkers vexed by the pervasive scent of marijuana smoke that now saturates certain areas of the state may find some relief on the horizon if a recently proposed bill gains momentum in the state legislature.

An assemblyman from upstate New York, Philip Steck, a Democrat, introduced a bill last week aimed at prohibiting residents from smoking marijuana in areas that could be frequented by children. Should this bill evolve into law, it would effectively restrict the act of lighting up for marijuana users in most public spaces throughout the state.

According to Mr. Steck, who has long been an advocate for marijuana legalization, the drug must be subjected to more robust regulation. He notes that constituents have raised concerns about the irresponsible consumption of marijuana in public spaces and in the presence of children.

He remarks, “No, you do not possess an inherent right to engage in any behavior you desire at any time, in any location, under any circumstances.” Mr. Steck emphasizes the importance of engaging in reasoned discussions about fair regulations for marijuana use, emphasizing that the current legislation is merely an initial version.

“People have the right to enjoy marijuana as long as it does not infringe upon the rights of others,” he adds.

In recent years, the smell of burning marijuana has become so pervasive in New York City that locals have playfully labeled it the “unofficial” scent of the metropolis, supplanting the stench of decomposing garbage that once characterized the city. Visitors from other states and countries describe the odor as overwhelming and bothersome to both non-smokers and occasional users.

The prevalence of marijuana odor even prompted complaints from players at the U.S. Open tennis tournament held last month at Flushing Meadows. During a match on Court 17, which is situated across from Corona Park, player Maria Sakkari voiced concerns to a chair umpire about the overpowering scent. Another player, Alexander Zverev, likened playing on the court to being in “Snoop Dogg’s living room.”

Since the state legalized recreational marijuana use in 2021 for adults aged 21 and over, individuals have been permitted to possess up to three ounces of cannabis for personal use. Currently, adult users are allowed to smoke or vape cannabis in areas where tobacco smoking is permitted.
